In accordance with its duty under Section 72(3) of the Anti-Social Behaviour Crime and Policing Act 2014, the Council would like to seek your views on the proposed extension of our Alley Gating Public Spaces Protection Order (‘PSPO’) using its powers under Section 60(2) and 61(1)(a) Anti-Social Behaviour Crime and Policing Act 2014 (the ‘Act’) and of all other enabling powers. The PSPO took effect on the 20th October 2020, was extended and varied for a further 3 years on the 20th October 2023 and unless extended again the original order will expire at midnight on the 19th October 2026.
At this stage the council is seeking to extend the order in its entirety. All of the 'gated areas' listed in the schedule within the proposed draft extended order have all been in place before, on or just after 2008/2009. The Council is not proposing to gate or restrict access to any other areas at this time.
Who does this consultation apply to?
The consultation in the main applies to those residents and businesses that have properties near to or within the gated areas. As part of the consultation, the Council is inviting residents who ‘DO NOT AGREE’ with the provisions of the draft PSPO to indicate this via this consultation and state the grounds on which they do not agree. Please only proceed with this consultation if you wish inform us that you do not agree with the councils intentions in relation to this PSPO.
If no such objections are duly made, or if any so made are withdrawn, the Council may make the Public Space Protection Order (PSPO). Even if any such representations or objections are made, the Council may nevertheless still extend the PSPO if it is appropriate for it to do so and in the interests of the wider community.
Should you currently rent the property you occupy, you must inform your Landlord/Lady or Letting Agent of this correspondence.
